新时代涉外法治人才培养的守正与出新

On the Maintenance of the Tradition and Innovation in the Cultivation of the Foreign-Related Rule-of-Law Talent in the New Era

当今世界正经历百年未有之大变局,全球化的趋势和对外开放的格局催生了大量高层次、专业化涉外法治人才的需求。涉外法治人才培养具有厚重的形成基础,当前的人才定位更具包容性,需要兼顾微观技艺与宏观视野。为此,人才培养要把握历史脉搏,紧贴国家战略需求,结合新时代背景兼顾守正与出新。一方面,坚守人才培养的基本规律与优秀传统,坚持价值引领、走内涵式发展道路、落实国际化育人、强调实践的重要性。另一方面,审视现有问题与最新形势,适当调整和出新,顺应分层培养的客观现实与规律,在强调本科宽口径、基础性教育和硕士专业化、类型化培养的基础上,重视博士研究生阶段人才培养的突破。涉外法治人才培养是复杂的系统工程,守正与出新的过程中需要适应多元化社会需求,深化实务部门与高校协同育人机制;适应复合型人才要求,倡导学科互动与学校互动,深化特色化发展之路;服务国家战略需求,重视国别法人才培养;推进国际化进程,由“单一输出”转向“输出与输入并重”;完善配套政策,实现多维度支撑与赋能。

Facing profound changes unseen in a century,the general trend of globalization and the overall situation of opening up have spawned the demand for a large number of high-level and professional foreign-related rule-of-law talent.The cultivation of foreign-related rule-of-law talent has a solid foundation.The current talent orientation is more inclusive,requiring both micro skills and macro vision.Talent cultivation should grasp the directions of the history,closely follow the needs of national strategy,and keep right and innovate in the context of the new era.On the one hand,legal education should adhere to the basic principles and fine traditions of talent cultivation.Legal education should also focus on value guidance and quality-orientation,which foregrounds the characteristics of internationalization and practice orientation.On the other hand,legal education should be adjusted and innovated appropriately on the basis of the existing problems and the latest situation.Legal education should be adopted to the talent cultivation at different levels according to reality and objective principles.Legal education should also attach importance to the breakthrough of talent cultivation in doctoral education stage in the background of“broad caliber-oriented”undergraduate education,which specializes the classification of different types in postgraduate education.The cultivation of foreign-related legal talent is a complex systematic project.The maintenance of the tradition and the innovation of legal education need to cater for the diversified social needs and deepen the collaborative mechanism between the practical departments and universities.Legal education should also adjust the demand of the cultivation of the compound legal talent,advocating the interaction of disciplines and the interaction of universities in order to deepen the path of the characteristic development.Legal education should serve the demand of national strategy,emphasizing the cultivation of the talent who know well of the laws in different countries in order to promote the process of internationalization and transferring the“single-sidedness”to“emphasizing both the input and the output”.In addition,legal education should optimize the supporting policies and realize the diversified support and empowerment.
