摘要
“一带一路”建设下涉非洲的法律服务市场领域不断拓宽,涉非洲的法治人才面临解决“独特而又复杂”的法律风险需求的严峻现实挑战。当前我国涉非洲的法治人才数量和质量的供给,均难以满足现实需求。传统涉非洲的法治人才培养模式存在简单套用“法学+外语”复合型国际化培养模式,培养目标不清晰,涉非洲的语言培训与法律课堂的实践性教学效果不佳,课程体系不完善,法律实践训练强度与海外非洲实务平台搭建力度不足等问题。对此,我国高校应以习近平法治思想为指引制定出明确且更具实践导向型的涉非洲的法治人才培养目标,参照国际经验逐步形成“法学+英语+非洲主要小语种+N”与“企政学研”一体化相结合的协同创新培养模式,尝试采取传统课堂与“诊所式”法律课堂交互式运作方式革新涉非洲的法学教学模式,强化法律研究课程在涉非洲的课程体系的中心地位,建立科学的涉非洲的法治人才考核评价认证体系。
In the background of the“Belt and Road”Initiative,China-Africa-related legal service market has been expanding.The China-Africa-related rule-of-law talent are facing the harsh challenge of the“unique and complicated”demand on legal risk(prevention).Traditionally speaking,the cultivation model of the Africa-related rule-of-law talent has been simply set to the international education model of the compound talent of“law+foreign languages”,which usually causes a series of problems in education:the unclear cultivation objectives,the lack of targets in Africa-related language training,the lack of practicality of Africa-related law teaching,insufficient curriculum system and the lack of platform for practice.In regard of these problems,the universities and colleges in China should take Xi Jinping Thought on the Rule of Law as the guidance to set a clear and practice-oriented cultivation model for Africa-related rule-of-law talent,which can employ the current successful international experience and establish the model like“Law+English+African minorities’language+N”and a collaborative innovation cultivation model that integrate“enterprises,governments,universities and research institutions”.Next,in the reform of the legal education,this model should adopt the interactive mechanism between the traditional classroom teaching and“Africa-related clinic”education.Other measures should also be included into the model,such as the strengthening of the center position of legal research courses in the Africa-related curriculum system and the establishing of the examination and assessment system for the teaching of the Africa-related rule-of-law talent.
