数字时代人才培养供需适配的法学教育因应

The Supply-and-demand Adaptation of Legal Education Response for Talent Cultivation in the Digital Age

数字时代的数智技术强势地改变了人类的生产生活方式,冲击了传统伦理价值和社会秩序,对法律人才的能力素质提出了新要求,使法学教育面临新挑战。法学教育的人才培养与供给应当与数字时代的社会需求相适配,回应性的法学教育应当体现数字时代“数智人文”交叉学科相嵌相融之内涵要求,这与新文科建设理念高度契合。但现行法学教育模式以及培养方案均未蕴含和彰显数智素养的时代之需,其教育教学内容设计亦为肤浅表象地简单植入,未能体现“数智+法学”的融通与交互。新文科语境下的法学教育转型改革,应当重塑时代价值理念,打破学科壁垒,创新教学方式和培养模式,构建新型理论体系和教学体系,建立产学研协同育人机制,满足“数智法治”的人才需求,彰显新文科“质性”。

The“digital￣intelligence technology”in the digital era has strongly changed the way of human production and life,impacted the traditional ethical values and social order,put forward new requirements for the ability and quality of legal talent,and made legal education face new challenges.The cultivation and supply of legal education talent should be compatible with the social needs of the digital era,and the responsive legal education should reflect the connotation requirements of the integration of“number,intelligence and humanities”in the digital era,which is highly consistent with the construction concept of new liberal arts.However,neither the current legal education model nor training program contains and demonstrates the need of the“digital literacy”era,and the design of educational and teaching content is implanted superficially which fails to reflect the integration and interaction of“digital intelligence+law”.In the context of new liberal arts,the transformation and reform of legal education should reshape the value concept of The Times,break disciplinary barriers among subjects,innovate teaching methods and training models,construct new theoretical system and teaching system,establish the cultivation mechanism of industry￣university￣research cooperation,meet the talent demand of“digital￣intelligence rule of law”,and highlight the“quality”of new liberal arts.
