摘要
随着大数据时代的到来,传统法理学课程的案例教学模式正在逐步向大数据在线案例库教学模式转型,以克服其“授而不新、学而不用”倾向、同质化现象、社会适应性不强等弊端。为了进一步提升法学本科生对法理学知识的理解和应用能力,本研究以案例教学法、基于情境认知与建构主义教学观以及大数据分析原理为理论基础,围绕“北大法宝”数据库构建起大数据在线案例库教学模式,并通过课堂实践证明了该模式有助于提升学生对法理学基础知识的深度理解和灵活应用。值得注意的是,大数据在线案例库教学模式并不适宜采用疑难案件作为案例样本,而应当采用具有普遍意义、典型意义的案例,并同时兼顾法律学科的人文关怀,以此提升法理学课程的实践性和价值性。
With the arrival of the big data era,the case teaching mode of traditional jurisprudence courses is gradually transforming to the big data online case library teaching mode to overcome its shortcomings of“Teaching but obsolete,learning but nonuse”,homogenization,poor social adaptability and so on.In order to further improve the ability of law undergraduates to understand and apply jurisprudence knowledge,this research builds a big data online case library teaching mode around the“PKU Law”database based on the theoretical basis of case teaching method,situational cognition and constructivism teaching concept and big data analysis principle,and proves that this mode is helpful to improve students’deep understanding and flexible application of basic jurisprudence knowledge through classroom practice.It is worth noting that the teaching mode of big data online case base is not suitable to use difficult cases as samples,but should use cases with universal and typical significance,and give consideration to the humanistic care of the legal discipline,so as to improve the practicality and value of the jurisprudence course.
