Research on the Effective Connection Mechanism between the Education of Master of Laws and Legal Professional Qualification Examination

法律硕士教育的发展关乎国家法治建设健康运行及行稳致远。我国法律硕士教育已成为培养高层次法律人才的重要途径,但是教学内容过于偏向理论而缺乏实践能力的培养模式,无法满足新时代法治人才需求。只有形成“法律职业共同体”精英化,才能适应新时代法治人才的需要,特别是在提高国家治理体系和治理能力现代化的发展趋势下,国家、社会对于法律人才的需求可谓是求贤若渴。故将“法律职业资格考试”与法律硕士教育有效衔接,找到契合的最优路径,则事倍功半,不仅提高法律工作者的理论素养,又提升处理法律问题的实践能力,形成多元有效衔接机制,从而为国家培养真正优秀的法律人才。

The development of the Education of Master of Laws is highly related to the healthy operation and stability of the construction of the rule of law.The education of Master of Laws in China has become an important way to cultivate high-level legal talent,but the teaching content is too theoretical and lacks the cultivation model of promoting practical ability,which cannot meet the needs of the rule-of-law talent in the new era.Only by forming an“elite community of legal professionals”can we meet the needs of rule-of-law talent in the new era,especially in the trend of improving the modernization of the national governance system and governance capabilities.The demand for rule-of-law talent by the nation and society can be described as a“thirst for talent”.Therefore,effectively linking the“Legal Professional Qualification Examination”with the education of Master of Laws,and finding the best path to match the situation,we will get double of the result with half the effort,not only improving the theoretical capabilities of legal profession,but also improving the practical capabilities to handle legal disputes,forming a diversified and effective connection mechanism,so as to cultivate outstanding the rule-of-law talent for the nation.
