回应社会需求的法官知识配置

On Judges’Knowledge Configuration that Responds to the Social Needs

为了缓解司法判决与社会需求之间的疏离感,在恪守司法的规律与内在逻辑的前提下,司法判决也不能全然不顾其社会效果。目前从司法审判改革入手也许能够有所改变。法官作为司法审判人员,其知识结构,尤其是社会知识就需要重新配置以使司法判决能够在坚持法律逻辑的基础上得到社会的认可。在法学教育、法官职业教育培训的知识配置上要逐步将社会知识纳入其中。

In order to alleviate the separation between adjudications and social needs,and under the premise of adhering to the laws and internal logic of justice,judicial decisions cannot be made disregarding of their social effects absolutely.Given that the current judicial reform cannot be accomplished overnight,it may make a difference to try to start it from the reform of adjudication.As the carrier of adjudication,judges and their knowledge structure,especially the knowledge on society needs to be reconfigured so that judicial decisions can be accepted by the society on the basis of adherence to legal logic.Judges’knowledge on society should be established based on legal education and professional training,where the knowledge can be transferred and learned at all levels.
