摘要
在网络文学快速发展的今天,版权保护一再遭遇各种新问题。江南的《此间的少年》作为中国网络文学首次十年盘点的“十大最佳作品”之首,因涉嫌侵权和不正当竞争,引发了一场旷日持久的版权保卫战。“金庸诉江南案”的意义不只是一位传统作家公开表示对网络侵权者的态度,实际上也为网络文学版权保护的深入和细化提供了一个可供参照的鲜活案例。作为“同人作品第一案”,其判决和相关争议,以及著作权保护范围等问题,都有值得深入思考和探讨的空间。关于作品相似元素属于“表达”还是“思想”的判断,对类似同人小说的侵权界定也具有十分重要的示范意义。
In the rapid development of online literature,copyright protection has encountered various new problems.Jiangnan’s The Boys in this Room,as one of the Ten Best Works in China’s first ten-year inventory of internet literature,has triggered a protracted copyright defense battle due to alleged infringement and unfair competition.The significance of the“Jin Yong v.Jiangnan”case is not only that a traditional writer publicly expressed his attitude towards online infringers,but also provided a vivid case for reference in the depth and refinement of copyright protection for online literature.As the first case of homoerotic works,its judgment and related disputes,as well as the scope of copyright protection and other issues,have much room for indepth thinking and discussion.The judgment of whether the similar elements of the work belong to expression or idea is also of great significance to the definition of infringement of similar homoerotic novels.
