摘要
随着物流区块链技术的快速发展,客户名单作为各市场主体之间完成交流和进一步促成交易的第一引流管,其对促进企业竞争力发展和发掘潜在客户所起到的作用不言而喻。传统意义上的客户名单,是指企业和个人在参与市场交易的过程中,对于自身具有利用价值并经过简单加工而形成的信息集合。要想将广义的客户名单从日常信息中剥离出来,并转化为法律意义上的客户名单从而受到法律的保护,其中权利人要付出千百倍的努力和辛劳。从社会控制论的角度来说,就是对物流客户名单进行价值评估,从法律层面上以商业秘密保护效益进行考量,以期求得对客户名单的最大保护力度。
With the rapid development of logistics blockchain,the customer list,as the first drainage tube to complete communication and further facilitate transactions between various market entities,plays a self-evident role in promoting the development of enterprise competitiveness and exploring potential customers.The traditional customer list refers to the collection of information,which is formed by enterprises and individuals in the process of participating in market transactions,has use value for themselves and is simply processed.To separate the broad customer list from daily information and transform it into a legal customer list protected by law,rights holders need to make hard effort.From the perspective of social control theory,it is to evaluate the value of the logistics customer list,and consider the benefits of trade secret protection from the legal level,in order to obtain the maximum protection of the customer list.
