中国式现代化视阈下知识产权保护的人民性

Affinity to People of IPR Protection from the Perspectiveof Chinese Path to Modernization

中国式现代化具有鲜明的人民性,作为中国式现代化建设的有机组成部分和中国式现代化建设的核心推动力量,知识产权保护也必须彰显其人民性。知识产权保护的人民性主要是指知识产权保护的各个方面、各个环节和各种行为都应当以广大人民为中心,都应当以广大人民的需求为念。知识产权保护人民性的实践路径主要是,“为了人民”的价值引领在知识产权公共政策中的体现,“依靠人民”的工作方法在知识产权保护过程中的运用,以及“人民共享”的理想效果在知识产权保护行动中的实现。从彰显人民性的要求出发,当前我国知识产权保护工作的重点是,加快提高乡村知识产权保护水平,严厉打击涉及公众切身利益的知识产权侵权行为,有力推动生态环境相关知识产权的产出与运用,高度重视文化领域知识产权保护工作,不断增强知识产权国际保护能力。

Because of Chinese path to modernization,IPR protection,as an important part and a core driving force of Chinese modernization,should accordingly show its affinity to people.Affinity to people refers to focusing on people and their needs in every fields,links and activities of IPR protection.To embody the affinity to people of IPR protection,the public IPR policies must represent the value“for the people”,IPR protection works must“rely on the people”,and the ideal interests“shared by the people”must be realized during the IPR protecting activities.Proceeding from the demands of the affinity to people,at present,Chinese IPR protection should put emphasis on the following points:quickly lifting the level of rural IPR protection,strictly punishing IPR infringements related to the public's interests,strongly promoting the outcome and use of IPR relative to ecological environment,seriously treating the IPR protection in the field of culture,and continuously strengthening the ability of international IPR protection.
