二次创作短视频合理使用认定问题探究

Exploration on the Recognition of Reasonable Use of Short Videos in Secondary Creation

【目的】网络时代背景下,通过对二次创作短视频合理使用的正当性和认定困境进行梳理分析,尝试从不同的视角为二次创作短视频的合理使用认定提供思路和建议。【方法】通过比较研究、文献研究、案例分析等方法,梳理目前二次创作短视频合理使用认定方法的优点和不足之处。【结果】当下对二次创作短视频合理使用认定的方法集中于“三步检验法”“四要素分析法”,但这些方法都存在难以克服的认定困境,二次创作短视频合理使用认定问题仍需要探索新的方向。【结论】针对上述方法的不足之处,本研究提出增加类型化视角、结合“法律+科技”认定方法等,尝试为二次创作短视频合理使用的认定提出完善建议。

[Purposes]In the context of the internet era,by sorting out and analyzing the legitimacy and recognition difficulties of the reasonable use of secondary creative short videos,this paper aims to provide ideas and suggestions for the recognition of the reasonable use of secondary creative short videos from different perspectives.[Methods]Through comparative research,literature research,case analysis,and other methods,the advantages and disadvantages of the current method for determining the reasonable use of secondary creative short videos are summarized.[Findings]The current methods for determining the reasonable use of secondary creative short videos mainly focus on the"three-step test method"and the"four element analysis method".However,these methods all have insurmountable difficulties in determining the reasonable use of secondary creative short videos,and new directions still need to be explored.[Conclusions]In response to the shortcomings of the above methods,this article proposes to add a typological perspective and combine the"law+technology"identification method,attempting to provide improvement suggestions for the reasonable use of secondary creative short videos.
