海南自贸港视角下《专利法》修改对专利行政执法和公共服务的影响

The Impact of Patent Law Amendment onPatent Administrative Enforcement and Public Services from the Perspective of Free Trade Port

为适应国际高标准经贸规则,国家和海南自贸港知识产权保护机制正处于完善和转型的关键时期。研究《中华人民共和国专利法》修改,以及在其影响下制定的《海南自由贸易港知识产权保护条例》,分析对国家层面及海南自贸港层面专利行政执法和专利公共服务的影响,发现《专利法》修改和《知识产权保护条例》的颁布确立了国家层面和海南自贸港层面专利行政管理部门的行政执法和专利公共服务的主要职能,在实践中产生了深远的影响。但《专利法》修改及《知识产权保护条例》也凸显了专利行政执法的分歧,在落实公共服务职能上面临着一些挑战。同时,《党和国家机构改革方案》颁布后,专利行政执法职能将会受到一定影响,《专利法》和《知识产权保护条例》都应据此作出相应调整。

In order to adapt to international high standard economic and trade rules,the intellectual property protection mechanism of the country and Hainan Free Trade Port is in a critical period of improvement and transformation.We study the revision of the Patent Law of the People’s Republic of China and the enactment of the Hainan Free Trade Port Intellectual Property Protection Regulations under its influence,and analyze the impact on patent administrative law enforcement and public services at the national and Hainan Free Trade Port levels.The revision of the Patent Law and the promulgation of the Intellectual Property Protection Regulations have established the main functions of administrative law enforcement and patent public services of the patent administrative departments at the national and Hainan Free Trade Port levels,which have had a profound impact in practice.However,the revision of the Patent Law and the Intellectual Property Protection Regulations have also highlighted the differences in patent administrative law enforcement,and face some challenges in implementing public service functions.At the same time,after the promulgation of the Party and State Institutional Reform Plan,the patent administrative law enforcement function will be affected to a certain extent,and corresponding adjustments should be made to the Patent Law and Intellectual Property Protection Regulations accordingly.
