医院视角下互联网医疗依法执业风险点及防范对策

Risk points and preventive measures for legal practice of internet medicine from the perspective of hospitals

随着网络时代与信息技术的迅猛发展,互联网医疗颠覆了优质治疗资源分配失衡的局面,一定意义上推动了医疗资源的发展,但由于法律问题复杂、高度依赖信息技术、不能开展接触性治疗的特殊性,相比于常规治疗来说,在主体资格、行医标准、患者权益、信息安全、人身安全等领域面临着许多问题。从医院监管角度入手,研究探索医务人员在互联网医疗执业活动中出现的执业风险问题,通过明确准入门槛与规范资质评估、细化接诊范围与规范诊治行为、风险防范提醒与患者知情权维护、提高信息安全和人身安全等措施开展风险预防,提供规范执业行为的措施,希望尽量减少互联网医疗纠纷现象的出现,为互联网诊疗的医疗安全与质量管理以及新时代智慧医疗健康的推进提出意见与建议。

With the rapid development of the internet age and information technology,Internet medical treatment has subverted the unbalanced distribution of high-quality treatment resources,and promoted the development of medical resources in a certain sense.However,due to the complexity of legal issues,the high dependence on information technology,and the particularity of contact treatment,compared with conventional treatment,it is difficult to carry out contact treatment.There are many problems in the fields of subject qualification,medical standards,patients’rights and interests,information security,personal safety and so on.Starting from the perspective of hospital supervision,research and explore the practice risk problems of medical personnel in Internet medical practice activities,carry out risk prevention by clarifying the entry threshold and standardizing the qualification assessment,refining the scope of treatment and standardizing the diagnosis and treatment behavior,reminding patients of risk prevention and safeguarding patients’right to know,improving information security and personal safety,and provide measures to standardize the practice behavior.It is hoped to minimize the occurrence of Internet medical disputes,and put forward opinions and suggestions for the medical safety and quality management of Internet diagnosis and treatment as well as the promotion of smart medical health in the new era.
