基层治理中法治思维的“亲民”向度

On the"People-Oriented"Dimension of the Rule of Law Thinking in Grassroots Governance

随着社会法治实践的深层次展开,大多数人已经基本具备法治意识,也逐渐形成了法治思维。但是由于受到“人治”思维惯性的影响,处于社会基层治理网中的一些执法者和管理者还不能正确运用法治思维维护社会治安、调节社会关系。在治理过程中,或者纯粹地追求执法结果与“法条”相一致而放弃自由裁量的空间,或者超越法律框架且以自我意志为主地行使公权力,或者仅把法治当作一道社会运行的既定程序而不管这道程序是否会损害社会运行活力等。之所以出现如此后果,是因为没有正确理解法治建设要把人民放在主体地位的价值追求,偏离了法治思维中的“亲民”向度,这些思维都不算是真正的法治思维。因此,在社会基层治理中,要正确运用法治思维,尤其要注重法治思维中的“亲民”向度。在基层治理中要关注人民群众的感受,保护好人民群众的尊严,提升治理者的法治思维,从而更好地坚持以人民为中心的发展思想,更好更快地推进全面依法治国。

With the deepening of social rule of law practice,the majority of people have already developed a basic awareness of the rule of law and gradually formed law thinking.However,due to the influence of inertia of"rule of man"thinking,some law enforcement and management personnel in the grassroots governance network are still unable to correctly apply the rule of law thinking to maintain social order and regulate social relations.In the process of governance,they either purely pursuing the consistency of law enforcement results with"legal provisions"and abandoning the space for discretion,or exercising public power beyond the legal framework and based on self-will,or only treating the rule of law as an established procedure for social operation,regardless of whether this process will harm the vitality of social operation,etc.The reason for such consequence is that there is no correct understanding of the value pursuit of putting the people as the main body in the construction of the rule of law,which deviates from the"people-oriented"dimension of rule of law thinking.Those practices are not considered true rule of law thinking.Therefore,in grassroots governance,it is necessary to correctly apply the rule of law thinking,especially focusing on the"people-oriented"dimension of the rule of law thinking.In grassroots governance,attention should be paid to the feelings of the people,the dignity of the people should be protected,and the rule of law thinking of administrators should be enhanced,so as to better adhere to the people-centered development concept and promote comprehensive rule of law more effectively and efficiency.
