非遗传承与发展的过程,实质上是附着于非遗之上的所有权和次生权利在传承主体之间流转、嬗变和演进的过程。在不同历史时期,与非遗相关的权利流转和嬗变各有其不同的特点与规律。在当今全球化时代,非遗权利牵涉不同主体之间的文化话语权争夺和国家文化主权维护。这就需要我们将保护民族文化内涵作为第一要旨的同时,综合采取知识产权转化确权、公私法结合等措施,为非遗保护与开发工作保驾护航,捍卫我国非遗的文化主权,切实提升全体民众的文化自信。

The inheritance and development of intangible cultural heritage is essentially aprocess of transfer and evolution of ownership and secondary rights attached to intangible heritage.In different historical periods,the circulation and evolution of intangible cultural heritage rights have their different characteristics and rules.In the era of globalization,the evolution of intangible cultural heritage rights has become an important carrier for competing for cultural discourse rights and safeguarding national cultural sovereignty.This requires that we protect the connotation of national culture as the first focus,at the same time,we should work on intellectual property transformation confirmation,the combination of public and private law to escort the protection and development of intangible cultural heritage.Only with these efforts will we be able to achieve the purposes of safeguarding the cultural sovereignty and effectively enhancing the cultural confidence of all the people.
