“双碳”目标下我国环境行政约谈制度的现实困境及其纾解

随着“双碳”目标的提出,我国社会治理转向绿色低碳和高质量发展,生态环境法治建设亟需在准确把握中国式现代化本质要求的基础上持续推进。环境行政约谈作为社会治理的重要手段,推动了环境行政执法方式和治理模式的深层次变革,回应了环境善治的现实需求。但其作为一种新型柔性行政行为,传统研究范式对其解释力不足,难以实现逻辑自洽。以环境法权结构论为范式,遵循“环境权利和环境权力统一体”的命题,探究环境行政约谈的研究范式、权利规范、权力规制、法权冲突的困境所在,在论证“环境权利—环境权力”二元架构的能动治理新模式基础上,从价值导向层面明确环境行政约谈的适用原则,从规范建构层面加强环境行政约谈的多位阶立法供给,从多元协作层面健全环境行政约谈的程序设计,提出环境行政约谈现实困境的纾解对策,从而推进共建、共治、共享环境善治新格局的形成。

The state actively yet prudently promotes peak carbon neutrality.Chinese social governance has shifted to low-carbon and high-quality development.Ecological-environmental issues have become an important part of social governance.As a new form of flexible administrative behavior,environmental administrative interview is difficult to realize logical self-consistency.Additionally,the traditional research paradigms lack explanatory power.This article takes the structure of Environmental Legal Structure Theory as the paradigm.And then the article tries to explore the practical predicament of research paradigm,power regulation,norms of rights and conflict of jurisdiction.Based on grasping the logic of the new dynamic governance model of the dual structure-environmental rights and environmental power.Firstly,it needs to clarify the basic concept and application principle of environmental administrative interview from the perspective of value orientation.Secondly,the level of normative construction needs to strengthen the multi-level legislative supply of environmental administrative interview.Thirdly,the government needs to improve the procedure design of environmental administrative interviews at the collaborative level.The aim of this research is to promote the construction of environmental rule of law.
