总体国家安全观视域下人类辅助生殖技术规制研究

Research on the Regulation of Human Assisted Reproductive Technology from the Perspective of the Overall National Security Concept

党的二十大报告指出,“优化人口发展战略,建立生育支持政策体系,降低生育、养育、教育成本”。在国家进一步完善和落实积极生育支持政策的背景下,人类辅助生殖技术的应用意义已经同人口发展、社会民生与国家安全存在密切关联。合理规制人类辅助生殖技术对于维护国家人口安全、生物安全与社会安全均具有积极意义。现行的人类辅助生殖技术法规存在立法层级不高、规制力度有限、法规之间冲突、权利规范性不足、伦理原则模糊、国家安全视角缺失等问题。从维护国家安全与社会稳定的角度出发,构建中国特色人类辅助生殖技术法律体系,确立人类辅助生殖技术法的立法原则,推进人类辅助生殖技术的刑法规制,推动政府、企业与社会公众的协同治理机制,对于强化人类辅助生殖技术法治建设具有重要价值。

Report to the 20th CPC National Congress of the Communist Party of China pointed out,“Optimize the population development strategy,establish a fertility support policy system,and reduce the cost of child⁃birth,parenting and education”.Under the background of the country's further improvement and implementa⁃tion of positive fertility support measures,the application significance of human assisted reproductive technol⁃ogy has been closely related to population development,social livelihood and national security.Reasonable regulation of human assisted reproductive technology is of positive significance for safeguarding national popu⁃lation security,biological security and social security.The current laws and regulations on human assisted reproductive technology have some problems,such as low legislative level,limited regulation,conflicts between laws and regulations,insufficient standardization of rights,vague ethical principles,and lack of national security perspective.From the perspective of safeguarding national security and social stability,it is of great value to construct the legal system of human assisted reproductive technology with China characteris⁃tics,establish the legislative principles of the basic law of human assisted reproductive technology,actively promote the criminal law regulation of human assisted reproductive technology,and promote the collaborative governance mechanism of government,enterprises and the public to strengthen the legal construction of human assisted reproductive technology.
