摘要
职场电子监控技术的广泛应用对劳动者的隐私权、个人信息等人格利益造成了显著的负面影响,因此有受法律规制的必要。然而,现有规制体系却面临着针对性措施匮乏的窘境,其合理完善方向应当是建立一套以劳动者数据隐私权保护为核心、差分隐私和职业健康法律制度为辅助的“一轴两翼”式的三元治理模式,令内部各项制度间能够互为呼应,做到兼具层次性及体系性。此外,由于电子监控带来的劳动者精神损害问题可视作数智技术冲击传统劳动关系的一个缩影,故该治理模式也需要能够被移植进其他数智技术的规制策略中,彰显其维护数智时代和谐劳资关系的积极作用。
The widespread application of electronic monitoring technology in the workplace has a significant negative impact on the privacy and personal interests of workers,so it is necessary to be regulated by law.However,the existing regulatory system is facing the dilemma of lack of targeted measures,and its reasonable improvement direction should be to establish a set of "one axis,two wings" three-way governance model with workers' data privacy protection as the core and differential privacy and occupational health legal systems as the supplement,so that the internal systems can echo each other and achieve both hierarchical and systematic nature.In addition,since the problem of mental damage caused by electronic monitoring can be regarded as a microcosm of the impact of digital intelligence technology on traditional labor relations,this governance model also needs to be transplanted into the regulatory strategies of other digital intelligence technologies,highlighting its positive role in maintaining harmonious labor relations in the digital intelligence era.
