积极刑法立法观的规范体现与合理限度

The Normative Reflection and Rational Limit on the Positive View of Criminal Law Legislation

积极刑法立法观属于刑法积极回应社会现实和参与社会治理的立法体现。刑事立法并不会直接回应社会现实,因为社会现实的立法诉求必然会经由刑事政策的判断而进一步体现为具体的刑事立法。刑事立法在回应社会现实需求的过程中不断增设新罪或者扩张构成要件的效力范围会导致犯罪圈的不断扩大,进而使得刑法规范在一些方面趋于严密。积极刑法立法观具有刑事立法顺应社会发展的必然性,但其应当保持合理限度。在《刑法修正案(十一)》中,刑事立法进一步体现出了严密化与精细化,其具体的规范体现主要是增加新的条文内容、修正原有条文内容、涉及的内容范围趋于广泛。在相应的刑事立法理念方面,积极刑法立法观与保守刑法立法观并非属于完全不同的立场,积极刑法立法观应当以保守刑法立法观中的权利和自由价值为根基,注意把握好刑法干预社会治理的合理限度并注重刑事立法的实效性。

The positive legislative view of criminal law reflects the legislative embodiment of criminal law which actively responds to social reality and participates in social governance.Criminal legislation does not directly respond to social reality,as the legislative demands of social reality will inevitably be further reflected in specific criminal legislation through the use of criminal policies.The continuous addition of new crimes or expansion of the scope of effectiveness of constituent elements in criminal legislation in response to social reality will lead to the continuous expansion of the criminal field,and thus make criminal law norms more stringent in some aspects.The positive view of criminal law legislation has the inevitability of adapting criminal legislation to social development,but it should maintain a reasonable limit.In the Eleventh Amendment to the Criminal Law,criminal legislation further reflects the rigorousness and refinement.The specific norms mainly reflect the addition of new content,revision of the original content,and a wider range of content involved.In terms of corresponding criminal legislation concepts,the positive criminal law legislative view and the conservative criminal law legislative view do not have completely different stances.The positive criminal law legislative view should be based on the rights and freedom values in the conservative criminal law legislative view,pay attention to grasping the reasonable limit of criminal law intervention in social governance,and pay attention to the effectiveness of criminal legislation.
