互联网诊疗范围监管完善研究

Research on the improvement of supervision of Internet diagnosis and treatment scope

《互联网诊疗管理办法(试行)》明确划定互联网诊疗的诊疗范围为“部分常见病、慢性病”+“复诊”,而实践中却出现对这两个限定范围双双越轨的情形。其背后存在法条限定不明、针对性监管依据缺失、信息系统支持不足的问题。当前的疫情形势助推了互联网诊疗相关领域的发展,也加深了进一步规范行业发展的必要。借鉴美国、日本、欧洲及中国台湾地区对于互联网首诊制约监管的相关经验,建议我国在明确诊疗范围限定的前提下,以加强立法及技术支持的手段完善对于互联网诊疗范围的监管。

"Administrative Measures for Internet Diagnosis and Treatment(Trial)"clearly defined the Internet diagnosis and treatment of"Some common diseases,chronic diseases"+"Re-diagnosis",but in practice there are two limits to the two cases of double derailment.There are some problems behind it,such as unclear legal provi-sions,lack of basis for targeted supervision and insufficient support of information system.The current epidemic situation has promoted the development of Internet diagnosis and treatment-related fields,but also deepened the ne-cessity for further standardized industry development.Based on the experiences of the United States,Japan,Europe and Taiwan Province,this paper suggested that our country should improve the supervision of the scope of Internet diagnosis and treatment by means of strengthening legislation and technical support.
