Research on the Copyrights Ownership of AIGC with Dual Subject Structure

【目的】解决AIGC著作权归属问题,能够起到明晰权责、定纷止争的作用,促进AIGC发展。【方法】采用人工智能创作过程分析方法。【结果】应用投资者、创作者二元主体结构划分了AIGC著作权归属,并进行了AIGC著作权保护理论探索。【结论】投资者、算法所有者、算法使用者对AIGC创作无直接贡献或贡献微小,赋予其邻接权以鼓励其投资、生成、传播AIGC;算法设计者直接决定AIGC创作质量,赋予其署名权以鼓励其发展AIGC创作技术,提高AIGC质量;数据库开发者根据算法设计者要求付出劳动获得邻接权,鼓励其积极参与创作。

[Purposes]Determining the ownership of AIGC copyrights can clarify the responsibilities and settle disputes,promoting the development of AIGC.[Methods]This paper adopts AI creative process analysis methods.[Findings]The dual subject structure of investors-creator was applied to divide the AIGC copyrights ownership and explore the theory of AIGC copyrights protection.[Conclusions]Since investors,algorithm owners,and algorithm users had no direct or little contribution to the creation of the AIGC,we granted them neighboring rights to encourage them to invest and disseminate AIGC.Algorithm designers directly determine the quality of the AIGC,So they were given the copyright of authorship to encourage them to develop AIGC creation technology and thus improving the quality of AIGC.Database developers were granted neighboring rights for their work at the request of AI algorithm designers to en⁃courage their active participation in the creation of the AIGC.
