我国算法知情权改良路径研究

摘要 为制衡算法权力,在相对人获取算法相关信息方面的“赋权”总体上分为两种进路:一是改良知情权,二是构建算法解释权。为寻求可行的最优答案,可知算法知情权是目前立法中主流角色,而解释权为边缘角色。并结合理论研究中对算法解释权的功能证成与质疑进行观察,发现算法解释权独立成权不周。因此,可以初步获得选择答案——改良算法知情权。接下来,需要发掘算法知情权具体改良路径,改良的第一步就是吸收“可理解性”,第二步是建构理论层面环节化的算法知情权权利束。以期为算法知情权保护所触发的立法、执法、司法以及守法(企业自律)提供可操作性指引。 In order to balance the power of algorithms,there are generally two approaches to empowering individuals in obtaining algorithmic information:improving the right to know,and constructing the right to interpret algorithms.To find the feasible and optimal answer,it can be seen that the right to know of algorithms is the mainstream practice in current legislation,while the right to interpret plays a marginal role.And based on the theoretical research on the functional justification and questioning of algorithm interpretation rights,it was found that the independent weighting of algorithm interpretation rights is not sufficient.Therefore,a preliminary answer to the question-improving the right to know of the algorithm-can be obtained.Next,it is necessary to explore specific improvement paths for the algorithm's right to know.The first step is to absorb“comprehensibility”,and the second step is to construct a theoretical bundle of algorithm’s right to know,so as to provide operational guidelines for le gislation,law enforcement,judiciary,and compliance(corporate self-discipline)triggered by the protection of algorithmic right to know.
