生成式AI背景下著作权侵权样态及其风险治理

Copyright infringement patterns and risk management in the context of generative AI

生成式AI作为最先进科学技术的代表大跨步走进人们生活的同时,也带来了著作权侵权风险问题。生成式AI不同于以往的专家系统那样只进行简单的系统分析或者只关注现有数据,而是可以生成新颖内容的人工智能。该技术的产生对现行的著作权制度造成了冲击,对生成式AI技术的侵权样态分析迫在眉睫。通过对生成式AI技术挑战背景下著作权侵权样态进行分析,从而提出以下三条建议:面对数据输入阶段的侵权风险,应完善法定许可制度;面对数据分析阶段的侵权风险,要加强行政监管;面对数据输出阶段的侵权风险,要优化平台治理。

Generative artificial intelligence(AI),as a representative of the most advanced science and technology,has made significant strides into people′s lives,but it has also brought about the risk of copyright infringement.Generative AI is different from previous expert systems that only perform simple system analysis or focus on existing data,but can generate novel content through artificial intelligence.The emergence of this technology has had an impact on the current copyright system,and it is urgent to analyze the infringement patterns of generative AI technology.By analyzing the copyright infringement patterns in the context of generative AI technology challenges,the following three suggestions are proposed:in the face of infringement risks in the data input stage,the legal licensing system should be improved;In the face of infringement risks during the data analysis stage,administrative supervision should be strengthened;In the face of infringement risks during the data output stage,it is necessary to optimize platform governance.
