基层社会是社会的基本构成单位,通常被认为是具有人口、文化、地缘属性的组织形态,与社会成员的生活息息相关。随着从农耕文明向商工文明的转型,基层社会的传统属性已有重大改观。国家和社会的快速发展对基层社会治理提出了新挑战和更高要求。依据治理理论,基层社会治理表现为参与主体的多元性和治理目标的多向度性。在法学视域中,法治保障是基层社会治理和保持社会秩序稳定的基本要求和必要途径。法治保障的回应体现在,国家法与“民间法”并举,强化法治思维,健全配套机制,实行“三治”融合。在提高国家治理能力与国家治理现代化的背景下,对基层社会治理法治保障进行深入研究正当其时。

Grass-roots society is the basic unit of society,which is usually considered as an organizational form with population,culture and geographical attributes,and is closely related to the lives of social members.With the transformation from farming civilization to commercial and industrial civilization,the traditional attributes of grass-roots society have changed greatly.The rapid development of the country and society poses new challenges and higher requirements for grassroots social governance.According to the governance theory,grass-roots social governance is characterized by the diversity of participants and the multi-dimensional governance objectives.From the perspective of law,the guarantee of the rule of law is the basic requirement and necessary way for grass-roots social governance and maintaining social order and stability.The response of the guarantee of the rule of law is reflected in the simultaneous development of hard law and soft law,strengthening the thinking of the rule of law,improving the supporting mechanism and implementing the integration of"three governance",Under the background of improving the ability and modernization of national governance,it is timely to make an in-depth study on the legal guarantee of grass-roots social governance.
