论代驾行业存在的安全风险及其控制

Study on the Safety Risks and Their Controls in the Driving Agency Industry

随着国家对酒后驾车的严厉管制,代驾作为新兴行业,在人们的日常出行中扮演着越来越重要的角色。本文通过对代驾行业管理现状进行分析,发现存在监管主体缺失、法律法规不健全、自身运营模式尚未成熟等问题,代驾各方主体面临人身、财产、法律责任等多方安全风险,提出完善行业机制、发挥政府机构市场干预职能、加强配套法律设施建设、成立代驾行业协会等措施。

With the strict regulation of drunk driving in China,driving agency,as an emerging industry,plays an increasingly important role in people's daily travel.This article analyzes the current management situation of the driving agency industry and finds that there are problems such as lack of regulatory bodies,incomplete laws and regulations,and immature operational models.All parties involved in driving agency face multiple safety risks such as personal,property,and legal responsibilities.Measures such as improving industry mechanisms,leveraging government agencies'market intervention functions,strengthening the construction of supporting legal facilities,and establishing a driving agency industry association are proposed.
