中央环保督察问责的规范分析及完善路径

Normative Analysis and Perfect Path of Accountability ofCentral Environmental Supervision

督察问责是中央环保督察制度最为重要、最为核心的内容,是落实生态文明体制改革“最严格责任追究”要求的关键环节。中央环保督察问责在取得显著效果的同时,也存在一些有待进一步改进的方面,包括规范依据、问责主体、问责对象、问责情形、问责程度等。本研究强调:中央环保督察问责规范效应的进一步发挥,需要合理处理中央环保督察制度与传统科层制的相互关系,以及改进我国环境治理在央地之间、部门之间、党政之间的体制性障碍,这是影响中央环保督察问责实效的关键核心要素。在此基础上,本研究创新性地提出,当前进一步完善中央环保督察问责制、深入发挥中央环保督察效能,需要明晰党政各部门职权配置及清单制度、完善督察异体问责机制、建构科学的责任认定及绩效评估机制以及进一步规范督察问责程序。

The administrative accountability of supervision is the most important and core content of the central environmental supervision system,which is the key link in implementing the requirement of“The strictest accountability”in the system reform of ecological civilization.While the accountability of the central environmental supervision has achieved remarkable results,there are still some aspects to be further improved,including the normative basis,the main body,the object,the situation and the degree of accountability.This study emphasizes that the further implementation of the normative effect of central environmental protection supervision accountability requires a reasonable handling of the interrelationship between the central environmental protection supervision system and the traditional bureaucratic system,as well as the improvement of institutional barriers in China s environmental governance between central and local governments,departments,and party governments.These are key core elements that affect the effectiveness of central environmental protection supervision accountability.On this basis,this study innovatively proposes that in order to further improve the accountability system of central environmental protection supervision and fully utilize the effectiveness of central environmental protection supervision,it is necessary to clarify the power allocation and inventory system of various party and government departments,improve the accountability mechanism of different types of supervision,construct a scientific responsibility recognition and performance evaluation mechanism,and further standardize the accountability procedures of supervision.
