浅析女性劳动者“月经假”——基于宪法角度

An Analysis of the Menstrual Leave of the Female Workers— From the Perspective of the Constitution

基于男女之间先天的差别,为了使女性劳动者休息权得到相对公平的保障,必须予以特殊保护,因此便衍生出“月经假”,探究女性劳动者生理期特殊对待的理论依据,主要是宪法休息权、人权理论、平等权,女性劳动者生理期“月经假”所引发的担忧与争议也有其现实基础。由于这一权益的特殊性,针对其政策的制定更应该综合性考虑各方因素,才能达到有效妥善保护女性休息权的目的。

Since men and women are physiologically different,“menstrual leave”was put forward to protect the right of women.This essay explores the theoretical basis for the special treatment of female workers in the menstruation from constitutional right of rest and equality and human right theory.There are also realistic concerns and disputes over the“menstrual leave”.Due to the special nature of this right,policy-making should involve different factors,so that female workers’right of rest can be protected.
