摘要
住房商品化改革后,我国城市社区形成了以住房私有产权为核心,以共有产权为纽带,以物业管理区域为边界的新型邻里关系。共有产权是社区业主基于物业共有部分所形成的相互勾连关系。同时,共有产权也嵌入到社区场域中,受到多元利益主体的交互建构。基于共有产权建设城市社区治理共同体,需要完善共有产权的明晰机制从而厘清社区多元主体的权责关系,优化共有产权的管理机制从而促进社区多元主体的合作共赢,培育共有产权的认同机制从而推动社区多元主体的价值共识,提高物权纠纷的化解机制从而加强社区多元主体的协商能力。我国城市社区治理应该跳出滕尼斯意义上的社区愿景,立足我国社会变迁、经济发展和政治体制的现实情境,基于共有产权的本质联系,建设社区治理共同体。
After the reform of housing commercialization,China's urban community has formed a new neighbourhood relation-ship with private property rights as the core,joint property rights as the link,and property management area as the boundary.Common property right is the mutual connection between homeowners based on the common part of the property.At the same time,the common property rights are embedded in the neighbourhood field and constructed by the interaction of multiple inter-est subjects.Community of urban neighbourhood governance based on common property construction,need to improve the clari-ty of property mechanism so as to clarify the responsibilities of neighbourhood multiple subject relationship,optimization of multiple subject property management mechanism to promote neighbourhood of win-win cooperation,cultivation of the recogni-tion mechanism of property right so as to promote the neighbourhood of plural value consensus.Improve the resolving mecha-nism of real right disputes so as to strengthen the negotiation ability of multi-subject neighbourhood.China's urban neighbour-hood governance should jump out of the neighbourhood vision in the sense of Tennis,based on their own social change,eco-nomic development and political system of the realistic situation,based on the essential connection of common property rights to build neighbourhood community.
