乡村振兴战略下地理标志保护的发展路径探究

Exploring the Development Paths of the Protection of Geographical Indications under the Strategy of Rural Revitalization

乡村振兴与地理标志的有机融合,既能推动地理标志的发展和完善,又能促进产业振兴进而推动乡村振兴,使得乡村振兴与地理标志相辅相成、相得益彰。本文系统梳理乡村振兴战略下地理标志保护的发展路径,探究地理标志在乡村振兴中的发展方向,着重阐释地理标志的定义与特征,分析世界主要国家和地区的地理标志保护机制,探究中国地理标志的海内外实践,以及地理标志保护在赋能乡村振兴发展过程中存在的主要问题与发展建议,并提出进一步完善地理标志相关法律法规的建立,开展地理标志助力乡村振兴专题调研,多维度推动地理标志全产业链综合效益提高,加强地理标志国际交流合作等具体措施,助力地理标志产品“走出去”,从知识产权维度助力乡村振兴顺利实现。

The organic integration of rural revitalization and geographical indications can not only promote the development and improvement of geographical indications but also promote industrial revitalization and rural revitalization,which makes rural revitalization and geographical indications complementary and mutually reinforcing.In this paper,we systematically sort out the development paths of the protection of geographical indications under the strategy of rural revitalization,explore the development trends of geographical indications in rural revitalization,focus on the definition and characteristics of geographical indications,analyze the protection mechanisms of geographical indications in some countries and regions,explore the domestic and international practice of Chinese geographical indications,as well as the main problems and development suggestions of the protection of geographical indications in the process of boosting rural revitalization and propose to further improve the relevant laws and regulations on geographical indications.It also proposes to carry out thematic research on geographical indications for rural revitalization,promote the comprehensive benefits of the whole industrial chain of geographical indications in multi-dimensional ways,and strengthen the international exchanges and cooperation of geographical indications,etc.,to help geographical indications products to go global and to contribute to the successful realization of rural revitalization from the dimension of intellectual property rights.
