农村土地承包经营权纳入不动产登记技术探讨——以湖北省枝江市为例

Discussion on the Technology of Incorporating the Contracted Management Right of Rural Land into the Real Estate Registration-A Case Study of Zhijiang City,Hubei Province

文章以湖北省宜昌市枝江市农村土地承包经营权省级试点项目为例,分析了农村土地承包经营权纳入不动产统一登记的技术路线及工作流程,重点对农村土地承包经营权数据整合中的数据对比分析、档案整理、数据逻辑关系重构、编码转换、数据整合建库、数据叠加分析等关键技术进行了探索与研究,并提出实践中农村土地承包经营权与其他不动产权的冲突,部分农村土地经营权字段在不动产系统中无对应字段,承包地块与不动产地籍子区不一致,部门职责分工与衔接相关问题的解决方案和典型问题的处理方式。

Taking the provincial pilot project of contracted management right of rural land in Zhijiang City,Yichang City,Hubei Province as an example,this paper analyzes the technical route and working process of incorporating contracted management right of rural land into unified real estate registration,the paper focuses on the exploration and research of key technologies in the data integration of contracted management right of rural land,such as data comparative analysis,archival arrangement,data logic relationship reconstruction,coding conversion,data integration and database construction,data overlay analysis,in the end,this paper proposes solutions to typical problems,which include the conflicts between contracted management right of rural land and other real estate rights in practice,some fields of rural land management rights do not have corresponding fields in the real estate system,the contracted land is inconsistent with the real estate cadastre sub-area,some problems in division of responsibilities and connection of departments.
