《最高人民法院、最高人民检察院、公安部关于依法惩治网络暴力违法犯罪的指导意见》依照刑法、刑事诉讼法及有关法律、司法解释的规定,结合执法、司法实践,对网络暴力违法犯罪案件的法律适用和政策把握问题作了全面的规定。该规范性文件共20条,涵括罪名适用规则、处罚界限、追诉程序、民事维权、诉源治理等内容,特别是对网络侮辱、诽谤的公诉标准、自诉转公诉程序等作了细化明确。本文对该规范性文件的制定背景、起草中的主要考虑和重点内容作了介绍。

The Guiding Opinions of the Supreme People’s Court,the Supreme People’s Procuratorate and the Ministry of Public Security on Punishing Cyber Violence Crimes in accordance with integrates Law the provisions of the Criminal Law,the Criminal Procedure Law,relevant laws and judicial interpretations,combined with law enforcement and judicial practice,providing comprehensive provisions on the legal application and policy grasp of the handling of cyber violence crimes.This normative document has a total of 20 articles,including applicable rules for charges,punishment limits,prosecution procedures,civil rights protection,source of action governance,and other contents.In particular,the prosecution standards for online insults and defamation,as well as the procedure for converting private prosecution to public prosecution,have been refined and clarified.This article introduces the background of the development of this normative document,the main considerations and key contents in its drafting.
