行业法视域下的教育法适度法典化 被引量:6

The Moderate Codification of the Education Law from the Perspective of an Industry Law

摘要 适度法典化,作为一种新型法典编纂模式,凸显了新兴行政立法领域的法典化与传统部门法法典化的范式差异,反映了法典化的目标确定与模式选择应立足特定立法领域自身特点的新认识。将其引入教育法法典化研究,对于凝聚学界关于教育法法典化特殊性的共识,推动教育法法典化的理论研究与实践探索,具有积极意义。教育法法典化的模式选择,是内外因共同作用的结果。教育法的行业法定位这一内生性因素,要求教育法法典化在追求价值基础的完备性、调整范围的全面性、规范编纂的整全性方面保持适度,决定了教育法法典编纂应当走适度法典化道路。推动教育法的适度法典化,应当注重法典规制结构的精简性,基本满足教育行业改革发展的整体性要求;注重法典规范形态的综合性,发挥好授权性、引致性、衔接性规范的积极作用;注重法典价值选择的衡平性,聚焦教育权与受教育权的良性互动。 Moderate codification,a new model of code compilation,highlights the paradigmatic difference between the codification in the emerging administrative legislations and the codification in the traditional sectoral laws,and reflects the new understanding that the selection of the goals and models for codification should be based on the characteristics of specific legislative fields.The introduction of moderate codification into the study of the codification of the education law is of positive significance for the establishment of the consensus of the academic circles on the particularity of the codification of the education law,and the promotion of the theoretical research and practical exploration into the codification of the education law.The choice of the model for the codification of the education law results from both internal and external factors.As an endogenous factor,that the education law is positioned in industry laws requires that the codification of the education law should remain moderate in pursuit of a complete basis of value,a comprehensive scope of adjustment,and an all-round standard for codification,and all this determines that the codification of the education law should take the road of moderate codification.To promote the moderate codification of the education law,we need to attach importance to the concise regulatory structure of the code so as to cater to the overall needs for the reform and development of the field of education;stress the comprehensive standard for codification so as to let it play a positive role in the establishment of a standard featuring empowerment,induction,and connection;and emphasize the equity in the selection of the value of the code,and focus on the positive interaction between the right to education and the right to receive education.
