数字货币时代中的“假币”及其概念重构

数字货币是货币的数字形式,是不具备实物形态的特殊人造物。数字货币的人造物本质及构成特征使假数字货币的产生具有了逻辑可能性,技术上的漏洞与缺陷使假数字货币的产生具有了客观可能性,数字弱势群体的存在为假数字货币的产生提供了外部环境。冒充行使货币职能或声称具有超出货币职能的功能、冒用央行名义发行或推广、违反数字货币的设计与发行规范是假数字货币的主要表现。数字货币时代的“假币”概念须在内涵上反映假数字货币的构成特征,在外延上纳入数字形式,同时扩展伪造或变造货币的手段与方式,以适应数字货币时代的假币法律规制需求。
