摘要
中国立足新的历史时期提出的“共同富裕”概念,包含“权利”“价值”“标准”三个维度。作为基本权利范畴,其蕴含着全体人民对美好生活的权利诉求;作为法治核心价值,其承载着公平正义之于社会的不可或缺性;作为发展和共享相统一的重要指标,其成为衡量法治水平的关键尺度。在中国式现代化背景下,发挥法治对共同富裕的保障作用,有必要构建共同富裕的法治体系,包括富裕型权利保障体系、普惠型法治服务体系、共建式法治运行体系、包容性法治价值体系等。
The concept of‘common prosperity'put forward by China in the new historical era consists of three dimensions,'rights',‘values'and'standards'.As a category of basic rights,it contains the claim of all people for the right to a better life.As the core value of the rule of law,it carries the indispensability of fairness and justice to a society.As an important indicator of the unity of development and sharing,it has become a key measure of the level of the rule of law.In the context of Chinese-style modernization,for the rule of law to play the role of guaranteeing common prosperity,it is necessary to build a rule of law system for common prosperity,which includes a rich-type rights protection system,a public-interest rule of law service system,a co-constructed rule of law operation system,and an inclusive rule of law value system,etc.
