德法合治视域下社会主义核心价值观融入法治建设的依据与路径

作为社会主义核心价值观融入法治建设的历史镜鉴,传统中国“德法合治”的成功范式昭示着新时代德法合治方略可行、必要。从法理依据看,将社会主义核心价值观融入法治建设,蕴含着党的主张上升为国家意志的逻辑必然,既是新时代坚持依法治国与以德治国相结合的必然要求,也是推进中国式法治现代化的必由之路。保障社会主义核心价值观融入法治建设各环节,基本进路是以社会主义核心价值观指引科学立法、保障严格执法、裨助公正司法、促成全民守法。

As a historical mirror of the integration of socialist core values into the construction of the rule of law,the successful paradigm of"rule by virtue and law"in traditional China shows that the strategy of rule by virtue and law in the new era is feasible and necessary.From the perspective of legal basis,the integration of socialist core values into the construction of the rule of law contains the logical necessity of the party's proposition rising to the national will.It is not only the inevitable requirement of the combination of the rule of law and the rule of virtue in the new era,but also the inevitable way to promote the modernization of the rule of law in China.To ensure that the socialist core values are integrated into all aspects of the construction of the rule of law,the basic approach is to use the socialist core values to guide scientific legislation,ensure strict law enforcement,help fair justice,and promote law-abiding by the whole people.
