摘要
遗传咨询具有专业性、精准性、伦理化和法治化的特点。我国遗传咨询存在的法律风险包括遗传咨询人员资质不符、泄露个人基因信息、危害生物安全、基因歧视、侵犯患者知情同意权、侵犯家族成员生命健康权。文章建议完善我国遗传咨询的对策,包括完善遗传咨询师的资格认证、完善个人基因信息保护的规定、完善规避生物安全风险的规定、完善反基因歧视的规定、完善患者知情同意权的规定、完善家族成员生命健康权保护的规定。
Genetic counseling has the characteristics of professionalism,precision,ethics and the rule of law.The legal risks of genetic counseling include unqualified genetic counselors,disclosure of personal genetic information,endangering biosafety,genetic discrimination,violation of patients’rights to informed consent and family members’rights to lives and health.The article suggests refining genetic counseling in China,including improving the qualification certification of genetic counselors,the regulations on the protection of personal genetic information,the regulations on avoiding biosafety risks,the regulations against gene discrimination,the regulation of the right to informed consent and right to life and right to health.
