行政处罚决定公开制度完善对策研究

Research on Countermeasures to Improve the Disclosure System of Administrative Punishment Decisions

行政处罚法规定具有一定社会影响的处罚决定应当公开,有助于发挥对行政相对人的教育作用和对社会公众的警示作用。但目前,我国关于行政处罚决定公开中存在着对“具有一定社会影响”的判断标准尚不明确;公开机制有关规定尚不完善以及错误公开后行政相对人的救济渠道不畅通等问题。笔者提出根据行政处罚决定公开所针对的客体的分类界定“具有一定社会影响”的标准,从公开内容的限度、时限和程序方面对行政处罚决定公开的有关规定进行完善、畅通错误公开后行政相对人的救济途径等完善对策。

The Administrative Punishment Law stipulates that punishment decisions with a certain social impact shall be made public,which is conducive to giving play to the educational role of administrative counterparts and the warning role of the public.However,at present,the judgment standard for"having a certain social impact"in the disclosure of administrative punishment decisions in China is not clear;imperfect regulations related to the disclosure system and the lack of remedy channels for administrative counterparts after erroneous disclosure.Based on the classification of the objects targeted by the disclosure of administrative punishment decisions,the author suggests defining the standard of"having a certain social impact",and improves the relevant provisions on the disclosure of administrative punishment decisions from the aspects of the limit,time limit,and procedures of disclosure content,and unblocks the remedy channels for administrative counterpart after erroneous disclosure.
