【目的】帮助审查员在专利审查中准确把握发明的实质,树立正确的证据意识,提高创造性评价的能力。【方法】针对产品或者方法权利要求创造性评判中原料用量评述的难点,选取两个审查案例,从正反两个角度探讨了创造性评判中用量的整体考量和证据意识。【结果】审查实践表明,审查意见通知书中是否采用了充足的证据,直接影响通知书的说服力、质量、效能,影响审查周期。【结论】在专利审查中,审查员应准确客观全面理解本申请和对比文件,合理预测申请人用量的争议焦点,并制定高效的检索策略,利用有效的证据对原料用量进行全面评述,打造高质量审查。

[Purposes]This paper aims to help patent examiners accurately view the essence of inventions,establish a correct sense of evidence and improve the ability in the creativity judgment during the patent examination.[Methods]Facing the difficulties in judging the material amount in patent creative evaluation,this paper selects two cases and discusses the overall consideration and evidence consciousness in patent creativity examination.[Findings]Whether sufficient evidence is used in the patent examination directly affects the quality and efficiency,and finally affects the review cycle.[Conclusions]During patent examination,patent examiners should objectively understand the invention and the compared documents,accurately predict the dispute over material amount from the applicant,and develop a efficient search strategy,utilize effective evidence to make a comprehensive comment on the material amount,so as to make high-quality patent examination.
