以人民为中心的体育主体性:体育权利保障的价值导向

People-centered Sports Subjectivity:The Value Orientation of the Protection of Sports Rights

该文运用文献资料、逻辑分析、对比研究等方法,从界定“体育权利”和“以人民为中心的体育主体性”的概念及其关系入手:一方面,体育权利保障彰显了以人民为中心的体育主体性,诠释了“人民至上”是中国式体育现代化的鲜明特征;另一方面,坚持以人民为中心的体育主体性是体育权利保障的根本原则和价值归依。该文基于新旧《体育法》文本对比的视角,分别论述了新修订《体育法》是如何在全民健身、学校体育、竞技体育、弱势群体以及体育产业的不同领域中开展体育权利保障,从而实现不同人民群体的体育主体性全区域、全行业、全生命周期覆盖的,并思考其需要进一步完善的地方,助推中国式体育现代化的进程,促进体育强国、健康中国建设。

This paper uses methods such as literature,logical analysis and comparative research to start from defining the concepts and relationships of"sports rights"and"people-centered sports subjectivity".On the one hand,the protection of sports rights highlights people-centered sports subjectivity and interprets"people first"as the distinctive feature of Chinese-style sports modernization.On the other hand,adhering to people-centered sports subjectivity is the fundamental principle and value orientation of safeguarding sports rights.Based on the perspective of the text comparison of the new and old Sports Law,this paper respectively discusses how the newly-revised Sports Law carries out the protection of sports rights in the different fields of national fitness,school physical education,competitive sports,disadvantaged groups and the sports industry,so as to realize the coverage of the sports subjectivity of different people groups in the whole region,the whole industry and the whole life cycle,and it thinks about the aspects that it needs further improving,in order to boost the process of Chinese-style sports modernization and promote the construction of a leading sporting nation and a healthy China.
