Comparative Study on International Cosmetics Regulatory Models

目的:为新时代我国化妆品监管模式的改革创新和提高国际化、现代化水平提供意见建议。方法:基于工商管理G管理模式构建由理念、结构、方式3个层次组成的化妆品监管模式分析框架,以美国、欧盟、日本、中国的化妆品法规为研究对象,从化妆品的法定概念定义、分类管理范围、安全监管结构、监管方式方法等进行比较研究。结果:国际化妆品监管存在社会主导的事后/事中监管、市场主导的事中监管、政府主导的全程监管3种模式。结论:创新我国化妆品监管模式需要在监管理念上更坚定制度自信、在监管结构上更加重视社会力量、在监管方式上更加注重对标国际。

Objective:This study aims to provide suggestions for reform and innovation of China's cosmetic regulatory model in the new era,with a focus on enhancing its internationalization and modernization.Methods:Based on the G management model in business administration,a research and analysis framework for cosmetic regulatory models is constructed,comprising three levels:philosophy,structure,and approach.The study focuses on cosmetic regulations in the United States,the European Union,Japan,and China,comparing them in terms of the statutory definition of cosmetics,classification and regulatory scope,safety regulatory structures,and regulatory approaches.Results:Three regulatory models for international cosmetic regulation are identified:society-led post/mid-event regulation,market-led mid-event regulation,and governmentled full-process regulation.Conclusion:To innovate China's cosmetic regulatory model,it is essential to strengthen institutional confidence in regulatory philosophy,pay greater attention to social forces in regulatory structure,and align regulatory approaches with international standards.
