关于陕西省秦始皇陵立法保护的分析与思考

Analysis and Reflection on Legislation to Protect Emperor Qin Shihuang’s Mausoleum,Shaanxi Province

文章通过总结和回顾陕西省关于秦始皇陵的立法实践活动,重点阐述了《陕西省秦始皇陵保护条例》的修订背景、修订过程和主要变化,分析了立法取得的经验和存在的不足,指出地方人大在制定文化遗产领域专项法规时,应当把握“不抵触、有特色、可操作”的立法原则,坚持问题导向,紧紧围绕遗产特性和地方工作实际,贯彻全过程民主,制定出务实管用、人民拥护、高质量的文化遗产地方性法规。

By summarizing and reviewing the legislative practice of Emperor Qin Shihuang’s Mausoleum in Shaanxi Province,this paper focuses on the revision background,revision process and main changes of the Regulations on the Protection of Emperor Qin Shihuang’s Mausoleum in Shaanxi Province,analyzes the experience and shortcomings of the legislation,and points out that when formulating special laws and regulations in the field of cultural heritage,the local people’s congresses should grasp the legislative principle of“non-conflict,distinctive and implementable”,focus on problem orientation,heritage characteristics and local work practice,ensure democratic process,so as to formulate practi cal,popular and high-quality local laws and regulatio ns in the field of c ultural heritage.
