人脸识别技术基于自身所独有的验证、辨识、分析功能而在诸多现实场景中得到普遍应用,但由于技术的新兴性、制度的缺失性以及立法层面的不完善性,也使得该技术被滥用的现象频繁发生,在应用过程中存在着侵犯隐私权、财产权、知情权以及个人信息权的法律风险,不仅带来信息安全风险,而且也容易引发技术进步与公民权利保护的失衡。为了使人脸识别技术更好服务于社会生产生活,需要在明确人脸识别技术应用法律风险的防范原则基础上,分别从完善事前的防范机制、事中监管措施以及事后司法救济渠道三方面来实现对人脸识别技术应用法律风险的防范。

Facial recognition technology has been widely used in many real-life scenarios based on its unique verification,recognition,and analysis functions.However,the emerging nature of technology,the lack of systems,and the imperfect legislation also lead to frequent abuse of this technology.In the process of application,there is a legal risk of infringing on privacy,property,information,and personal information rights,Not only does it pose huge risks and hidden dangers to people's facial information security,but it also easily leads to an imbalance between technological progress and the protection of civil rights.Therefore,in order to better serve social production and life with facial recognition technology,it is necessary to clarify the principles for preventing legal risks in the application of facial recognition technology,and to implement the prevention of legal risks in the application of facial recognition technology from three aspects:improving the pre prevention mechanism,in process supervision measures,and post judicial relief channels.
