摘要
涉农药司法鉴定工作、鉴定人和专家辅助人有助于专业性较强的涉农药案件纠纷化解。我国现阶段涉农药案件中专家辅助人制度存在缺陷和漏洞,如专家辅助人的意见处理错误、选任标准不明、参诉程序不清等,基于涉农药案件的特点,结合域外关于专家证人、诉讼辅佐人和技术顾问的经验,提出专家辅助人制度在我国涉农药案件中的健全完善相关建议。
Pesticide forensic work,appraisers and expert assistants are conducive to resolving disputes in highly professional pesticide cases.This paper aims at the defects and loopholes of expert assistant system in pesticide cases in our country at the present stage,such as the opinions of expert assistants are handled incorrectly,the selection criteria are unclear,and the procedures for participating in the lawsuit are unclear,basing on the characteristics of pesticide cases,and combining the experience of expert witnesses,litigation assistants and technical advisers in the extra-territorial expert system,putting forward some suggestions on the improvement of the expert assistant system in the cases involving pesticides in China.
