著作权法中合作创作的数智化之维

Collaborative Creation of Copyright Law in Logic of Digital Intellectualization

社会分工的精细化、读者需求的多样化、创意实现的复杂化促使作者选择合作的方式完成作品的创作。但在决策与执行自动化的现实背景下,时间与空间相分离的数智化之维正在改造着合作创作的基本形态。这一过程中,不同创作因子的“结合”或“融合”所形成的合作作品,其著作权共有结构面临着主体、客体样态的逐渐转变。著作权法中对于“合作作者”与“合作作品”的规制在这一维度下是否仍具有现实效用,需结合规范的基本形态、合作创作关系的基本矛盾进行具体分析。尽管“合作作者”与“合作作品”在数智化之维中实现了革新,但“合作创作”内生的复杂问题在本质上并未改变。

The refinement of social division,the diversity of readers’needs,and the complexity of creative realization prompt authors to choose collaborative approaches to complete their works.In this process,the common structure of copyright of joint works formed by the“combination”or“fusion”of different creative factors is facing the examination,the initial form of its subject and object is gradually changing.Whether the regulation of“joint authorship”and“joint works”in the Copyright Law is still effective in this context needs to be analyzed in the context of the basic form of the regulation and the basic contradiction of the joint creation relationship.Although the concepts of“joint authorship”and“joint works”have been innovated in the logic of digital intellectualization,the complex problems inherent in“joint creation”have not changed in essence.
