The Main Forms of Legal Axioms

法的公理是人类对法及全部法现象不言自明的逻辑起点和共同价值追求,具有社会性、共识性、本源性、价值性四个特征。法的公理在不同理论渊源中表现出不同的形态。纵观当今世界各国立法,其中蕴含的法的公理主要表现为人权保障、公平正义、诚实守信、公序良俗、社会和谐、产权保护、人身自由、以人为本、程序正当和尊重自然等十种主要形态。这十种法的公理的主要形态在各部门法所蕴含的法的“殊理”的调节下,衍生出了世界各国法律丰富的法律原则和法律规范,构建起当前人类社会基本的法秩序。科学运用法的公理,要在法的公理的具体实现中贯彻新发展理念、构建新发展格局,从而推动实现更高水平的社会主义法治,助推实现全体人民共同富裕的伟大目标。

Legal axioms are the logical starting point and shared value pursuit of human beings regarding law and all legal phenomena.They possess four characteristics:sociality,consensus,originality,and value.Legal axioms manifest themselves in different forms in various theoretical sources.Observing legislation in different countries around the world,the main forms of legal axioms include the protection of human rights,fairness and justice,honesty and trustworthiness,public order and good morals,social harmony,protection of property rights,personal freedom,human-orientation,procedural justice,and respect for nature.These main forms of legal axioms,under the regulation of the“distinct theories”inherent in different legal sectors,have given rise to a rich set of legal principles and norms in the laws of countries worldwide,establishing the fundamental legal order of contemporary human society.The scientific application of legal axioms should be carried out through the specific implementation of these axioms,promoting new development concepts and patterns,and thus promoting the realization of a higher level of socialist rule of law and contributing to the achievement of the great goal of common prosperity for all people.
