论全过程人民民主根本制度和基本制度

On the Fundamental System and Basic System of the Whole Process of People’s Democracy

文章通过梳理和研究宪法规定人民民主制度的具体条款,以期明确全过程人民民主的宪法依据和制度体系的主要内容。研究表明,宪法确认了人民的主权者地位,创制了全过程人民民主的根本制度和基本制度。全过程人民民主的根本制度是人民代表大会制,基本制度是中国共产党领导的多党合作和政治协商制度、民族区域自治制度、基层群众自治制度,这四项制度是其制度体系中的核心内容,是对我国原有的根本、基本政治制度的新的理论表达和分类。新的理论表达更完整准确地体现了我国国家性质,即人民民主是构建我国政治制度和宪法法律的基石和框架,据展了人民民主制度体系的外延。今后的制度构建和完善重在践行时空上的“全过程”,不断充实人民民主制度的血肉。《选举法》《组织法》《民族区域自治法》等法律法规规章据此不断充实和细化各项人民民主措施和程序,切实有效扩大了公民有序政治参与。

This study aims to clarify the institutional carrier of the entire process of people’s democracy and continuously improve the institutional system of the entire process of people’s democracy by studying the provisions of China’s Constitution.It indicates that the Constitution recognizes the sovereignty of the people and the fundamental system and basic system of the entire process of people’s democracy and constructs an institutional system of the entire process of people’s democracy based on democratic centralism.The People’s Congress system is the fundamental political system of our country and the fundamental system of the entire process of people’s democracy.The system of multi-party cooperation and political consultation led by the CPC,the system of regional ethnic autonomy,and the system of grass-roots mass autonomy are not only the basic political system of our country,but also the basic system of people’s democracy in the whole process.The fundamental system and basic system of people’s democracy throughout the process is the core content of the system of people’s democracy throughout the process.According to the fundamental system and basic system of the entire process of people’s democracy,the electoral law,organizational law,regional ethnic autonomy law and other laws,regulations and rules constantly enrich and refine various people’s democratic measures and procedures,effectively expanding orderly political participation of citizens.
