《立法法》对依宪立法原则的完善

On the Improvement of the Principle of Constitution-based Legislation by the Legislation Law

长期以来,我国法学理论界对于依宪立法原则的研究成果比较少。2000年制定的《中华人民共和国立法法》关于依宪立法原则的规定内涵不够完整。新时代推进高质量立法和更好发挥宪法在治国理政中的重要作用,需要完善依宪立法原则。在习近平法治思想特别是依宪立法理论指导下,2023年修改后的《中华人民共和国立法法》不仅在法律条文表述上丰富了依宪立法原则的内涵,而且在全国人大及其常委会的立法权限、立法机制、备案审查制度中体现了依宪立法原则的要求。依宪立法原则是立法的首要原则。不断完善依宪立法、依法立法原则,是法治立法原则的必然要求。

For a long time,there have been relatively few research achievements on the principle of constitution-based legislation in the legal academia of China.The provisions of the Legislation Law enacted in 2000 on the principle of constitution-based legislation do not stipulate complete connotation.In the new era,in order to promote high-quality legislation and give full play to the important role of the Constitution in governing the country,it is necessary to improve the principle of constitution-based legislation.Under the guidance of Xi Jinping's Thought on the Rule of Law,especially the theory of constitution-based legislation,the Legislative Law revised in 2023 did not only enrich the connotation of the principle of constitution-based legislation in the expression of legal provisions,but also reflected the requirement of the principle of constitution-based legislation in the legislative authority,legislative mechanism and filing review system of the National People's Congress(NPC)and its Standing Committee(NPCSC).The principle of constitution-based legislation is the primary principle of legislation.It is an inevitable requirement of the legislative principle of rule of law to constantly improve the principle of constitution-based and law-based legislation.
