Chang Chien and Trademark Design and Protection in Modern China

张謇系中国工业化之初享誉国内外的工业领袖。本文以张氏运营大生纱厂关于商标的使用、设计、注册与保护的具体实践为例:从设计角度,对张氏推动近代商标文化生态的建立予以梳理与分析;从史料角度,对张氏推进近代商标法治的历史进行描述与阐释;进而讨论晚清民国初期身为企业家和农商总长的张謇,为中国近代商标设计和保护所做出的努力和贡献。

Prominently situated among the vanguard of China's early industrialization trailblazers was Chang Chien.This study delves into Chang's proactive engagement with the Dasheng Cotton Mill Enterprise trademark,scrutinizing his strategies in utilization,design,registration,and protective measures.Through a design-centric lens,the study scrutinizes and dissects Chang's profound influence on the formation of a contemporary trademark ecosystem.Moreover,employ-ing a historiographical framework,the study narrates and analyzes Chang's pivotal role in spearheading the evolution of modern trademark legislation.The central objective of this study revolves around illuminating Chang Chien's multifaceted contributions and endeavors within the realm of modern trademark design and pro-tection,particularly during the late Qing Dynasty and the early Republican period,wherein he assumed the roles of an entrepreneur and the Director-General of the Ministry of Agriculture and Commerce.
