从“学科茧房”到“破茧而出”:法学学科融合的逻辑理路与应然选择

From“Subject Cocoon Room”to“Breaking Out of the Cocoon”:The Logical Path and Necessary Choice of the Integration of Law Disciplines

学科茧房导致专业知识的摄取桎梏于某一学科固有领域,使得学科之间存在泾渭分明的壁垒。如何打破“学科茧房”,实现“破茧成蝶”的锐变成为了新文科建设中法学研究的重要抓手。为了解决法学学科的规范话语与其他学科研究范式的界限、法学跨学科研究的工具性制约因素,以及法学跨学科研究在国别问题中的局限性等现实困境,应当建构多学科交流、跨学科研究、跨领域阐释和跨区域借鉴的“四位一体”模式,以培养方式打破学科体系固有窠臼,以开放式学科边界促导跨学科共识的形成,促进法学跨学科研究工具的创新与运用,拓宽法学跨学科研究在国别问题中的视野格局,进而使法学学科从“学科茧房”到“破茧而出”,实现学科融合的基本目标,不断完善具有中国特色社会主义的法学教学科研体系。

The cocoon of disciplines leads to the continuous intake of professional knowledge being constrained by the inherent fields of a certain discipline,resulting in clear barriers between disciplines.How to break the cocoon of disciplines and achieve the sharp transformation of“breaking the cocoon into a butterfly”has become an important focus for legal research in the construction of emerging liberal arts.In order to address the boundaries between the normative discourse of the legal discipline and other research paradigms,the instrumental constraints of interdisciplinary legal research as well as the limitations of interdisciplinary legal research in national issues,a four-dimentional connectivity of interdisciplinary communication,interdisciplinary research,cross domain interpretation and cross regional reference should be constructed.It is beneficial to break the inherent mold of the disciplinary system through training methods and promote the formation of interdisciplinary consensus through open disciplinary boundaries.The innovation and application of interdisciplinary research tools in the field of law broaden the horizon of interdisciplinary research in national issues,thereby enabling the discipline of law to realize a transition from a“cocoon of disciplines”to a“breakthrough”,achieving the basic goal of disciplinary integration and continuously improving the legal teaching and research system with Chinese characteristics socialism.
