摘要
“异化”的无讼存在于古代中国社会,其不仅违背传统中国文化,亦违背现代文化。欲探寻“无讼”本身须从被“悬置”状态出发,经本土之历史性与现实性发展,即以“教化”为思想前提,辅以儒家“仁”“义”与道家“不争”之德性,在社会治理语境中得到“实体即主体”的实现。
The“alienation”of the“non-litigation”exists in ancient Chinese society,which is not only contrary to tradi-tional Chinese culture,but also contrary to modern culture.In order to explore the“non-litigation”itself,the“non-litiga-tion”should evolve from the state of“epoche”with historicity and reality.The evolvement regards the enlightenment as thought premise,which not only assisted by the virtue of Confucian“Yi”and“Ren”but also assisted by the virtue of Daoist“non-contention”.In the context of social governance,the“non-litigation”evolves to the state of“substance being subject”.
