体育赛事直播节目的著作权保护——以IPTV平台接入直播频道进行体育赛事直播侵权案为例

Study on the Copyright Protection of Live Sports Events——Taking the Infringement Case of IPTV Platform Accessing Live Streaming Channels for Sports Events as an Example

理论界与司法界对于体育赛事直播节目应定性为“视听作品”还是“录像制品”一直存在争议,对案例审判并无统一标准。之所以发生该争议,有两个层面的原因:以体育赛事直播节目独创性的有无作为区分的根本标准无统一认知;《著作权法》未明确规定体育赛事直播节目归属。文章以“IPTV平台接入直播频道进行赛事直播侵权案”为例,以2021年新《著作权法》为依据,对体育赛事直播节目是否具有独创性进行具体分析。结果表明,体育赛事直播节目应属于视听作品;在立法层面,应确定体育赛事直播节目性质、统一裁判标准;在司法层面,应明确体育赛事直播节目权利归属与责任划分。

There has always been controversy between the theoretical and judicial circles over whether live sports events should be classified as“audio-visual works”or“video products”,and there is no unified standard for case trials.The reason for this dispute is twofold:the lack of a unified standard of the originality of live sports events as a basis for differentiation;The Copyright Law does not explicitly stipulate the attribution of live sports events.Accordingly,taking the example of infringement of IPTV platform accessing live streaming channels for sports events,the article aims to examine whether sports event live streaming programs have originality based on the new Copyright Law of 2021.The results indicate that live streaming of sports events should belong to audiovisual works;At the legislative level,its nature should be determined and judgment standards be unified;At the judicial level,the attribution of rights and division of responsibilities should be clarified.
